TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the services provided by NetCheck Pro ("Company"), located in Austin, Texas. By accessing or using our services, you agree to comply with these Terms and any applicable laws and regulations. If you do not agree with these Terms, you must not use the services.


1. Acceptance of Terms


By using NetCheck Pro's platform and services, you acknowledge and agree that you are bound by these Terms. These Terms constitute a legally binding agreement between you ("User" or "Customer") and the Company. Continued use of our services constitutes acceptance of any modifications to these Terms.


2. Services Provided


NetCheck Pro specializes in offering solutions tailored to the needs of Money Services Businesses (MSBs). The following services are provided:


Online Services (Available Nationwide in the United States):


  • Custom AML Policy Generation: Enables MSBs to generate Anti-Money Laundering (AML) policies tailored to their operations, ensuring compliance with the Bank Secrecy Act (BSA).
  • Returned Checks Collection Management: Allows MSBs to efficiently manage and track returned checks via the online platform.
  • Profit and Loss Management: Provides MSBs with tools to monitor and analyze financial performance.
  • AML Compliance Management: Assists MSBs in maintaining compliance with federal and state AML regulations.


Services Available in Texas:


  • Independent Review for MSBs: Comprehensive independent compliance reviews of MSBs operating in Texas to ensure adherence to BSA and AML requirements.
  • Certified Mail Requests for Returned Checks: Facilitates the sending of certified mail for collections purposes.


Services Exclusive to Austin, Texas, and Surrounding Cities:


  • District Attorney Filing for Check Collection: Filing cases for returned checks with local District Attorneys’ offices.
  • Documents Notarization: Notarization services for documents related to MSB operations or other legal needs.
  • Courier Services: Secure pickup and delivery of documents and other business-related items.

The Company reserves the right to modify, add, or discontinue services without prior notice.


3. Eligibility and Geographic Restrictions


  • You must be at least 18 years of age and legally capable of entering into a binding contract to use our services.
  • Certain services are subject to geographic restrictions as outlined above. It is the User’s responsibility to ensure their location complies with the availability of the specific services they seek to utilize.


4. User Responsibilities


By using the services, you agree to:

  • Provide accurate, current, and complete information as required during registration or use of the platform.
  • Comply with all applicable federal, state, and local laws, including the Bank Secrecy Act, USA PATRIOT Act, and any relevant state money services regulations.
  • Use the services only for lawful purposes and refrain from engaging in fraudulent, harmful, or abusive conduct.
  • Maintain confidentiality of your account credentials and immediately report any unauthorized access or use of your account.

Failure to adhere to these responsibilities may result in suspension or termination of access to NetCheck Pro's services.


5. Payment Terms


  • Finality of Fees: All fees for services provided by NetCheck Pro are final and non-refundable.
  • Payments must be made in accordance with the payment terms specified on the platform. Failure to make timely payments may result in suspension or termination of services.
  • Users acknowledge and agree that once services are accepted and initiated, no refunds will be issued under any circumstances.


6. Refund Policy


  • The Company maintains a strict no-refund policy. Users are encouraged to review all service details and agreements carefully before committing to payment.
  • By proceeding with any service, you expressly waive any right to dispute charges based on refundability.


7. Intellectual Property


All content, software, and features available through NetCheck Pro, including but not limited to text, graphics, logos, and trademarks, are the sole property of NetCheck Pro or its licensors and are protected by intellectual property laws. Users may not reproduce, distribute, or modify any content without prior written consent from the Company.


8. Privacy Policy


Your use of NetCheck Pro’s services is subject to our Privacy Policy, which explains how we collect, use, and protect your data. By using our services, you consent to the collection and use of your information as outlined in our Privacy Policy.


9. Geographic Availability of Services


Users must ensure that the services they seek to use are available in their location as outlined in Section 2. NetCheck Pro is not liable for misuse or unavailability of services outside of designated areas.


10. Disclaimers


  • NetCheck Pro provides its services "as is" and "as available" without any warranties, express or implied.
  • The Company does not guarantee uninterrupted or error-free service and shall not be held liable for any interruptions or inaccuracies.


11. Limitation of Liability


To the fullest extent permitted by law:

  • The Company, its affiliates, and employees shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use or inability to use the services.
  • The Company’s total liability for any claims shall not exceed the total amount paid by the User for the service in question.


12. Termination


NetCheck Pro reserves the right to:

  • Suspend or terminate a User's access to the platform at its sole discretion for violations of these Terms or applicable laws.
  • Discontinue services or terminate accounts without prior notice if fraudulent or abusive activity is detected.

Upon termination, all rights granted to the User under these Terms will cease immediately.


13. Amendments


NetCheck Pro reserves the right to update or modify these Terms at any time. Notice of any significant changes will be provided on the platform or via email. Continued use of the services after such changes constitutes acceptance of the updated Terms.


14. Governing Law and Dispute Resolution


These Terms are governed by the laws of the State of Texas. Any disputes arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in Travis County, Texas.


15. Force Majeure


NetCheck Pro shall not be held liable for delays or failure in performance resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, labor disputes, governmental actions, or failures of technology providers.


16. Indemnification


You agree to indemnify, defend, and hold harmless NetCheck Pro, its affiliates, and employees from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or applicable laws.
